Jobspiq Terms of Service.

By creating an account or using Jobspiq ("the Service"), you agree to these Terms of Service ("Terms"), including the sections below that limit our liability and require you to resolve disputes with us through arbitration rather than in court. If you do not agree, do not create an account or use the Service.

Jobspiq aggregates publicly available job listings from third-party portals and uses semantic AI matching to surface relevant opportunities for registered engineers. We are not a recruitment agency, staffing firm, or employer, and we do not guarantee job placement, interview calls, or employment outcomes of any kind.

The Service is currently in beta and provided free of charge. Features, scoring logic, and availability may change, be added, or be removed at any time without notice, and we make no commitment to any particular uptime, response time, or feature roadmap.

The Service is intended for users 18 years of age or older. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. Accounts found to belong to a minor will be terminated and the associated data deleted.

You must provide accurate information at registration and keep it up to date. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access we are not liable for any loss arising from your failure to safeguard your credentials.

One account per natural person. Automated account creation, scraping, or bulk API access without our prior written permission is prohibited and may result in immediate termination without notice.

Recruiter accounts must be registered with a verified corporate domain. Access to candidate data is limited to candidates who have applied to your posted roles. Cold-messaging candidates outside the platform using data obtained through Jobspiq is prohibited.

Recruiters are solely responsible for the legality, accuracy, and completeness of every job posting they publish, and for compliance with all applicable labour, employment, equal-opportunity, and data-protection law in every jurisdiction where they hire. Jobspiq does not vet, endorse, or verify recruiter-submitted postings before or after publication and accepts no responsibility for their content. As set out in Indemnification below, recruiters indemnify Jobspiq against any claim arising from their postings or hiring conduct.

You agree not to:

• Scrape, copy, or mirror job data or candidate profiles at scale.
• Post false, misleading, or fraudulent job listings, or misrepresent your identity, company, or affiliation.
• Attempt to reverse-engineer the matching algorithm, probe, penetration-test, or gain unauthorised access to backend systems.
• Use the Service to send unsolicited commercial communications, spam, or malware.
• Impersonate other users, companies, or Jobspiq staff.
• Upload content that is unlawful, defamatory, harassing, or infringes a third party's rights.
• Circumvent rate limits, fair-usage caps, or any other technical restriction we put in place.

We may investigate and take any action we deem appropriate including suspension, termination, and reporting to law enforcement for suspected violations, without prior notice.

Job listings displayed on Jobspiq are sourced from third-party portals (LinkedIn, Naukri, Indeed, and others) and, in some cases, directly from recruiters. Jobspiq makes no representation or warranty about the accuracy, completeness, legality, or continued availability of any listing. A listing may be outdated, filled, or removed by the source portal without our knowledge. Always verify role details, compensation, and legitimacy directly with the employer before applying, interviewing, sharing personal documents, or accepting an offer.

Jobspiq aggregates listings from external sources and cannot guarantee that every posting or every party you interact with through the Service is genuine. We are not responsible or liable for fraudulent job postings, phishing attempts, identity theft, or any scam conducted by a third party using a listing surfaced by Jobspiq.

As a rule of thumb: a genuine employer will never ask you to pay money for "training," "equipment," "processing," or any other reason to be considered for or to accept a job. If you encounter a suspicious listing, please report it to [email protected] so we can review it, but we do not guarantee removal within any specific timeframe and accept no liability for losses suffered before a report is made or acted upon.

Jobspiq is a technology platform that aggregates and ranks publicly available job information. We are not a party to, and assume no responsibility for, any employment relationship, offer, contract, or negotiation between you and any employer or recruiter. We are not responsible for workplace conditions, compensation disputes, discrimination, harassment, wrongful termination, or any other matter arising once you engage with an employer those disputes are exclusively between you and that employer.

Jobspiq uses artificial intelligence including large language models operated by us and by third-party providers to generate match scores, extracted skills, job-description quality scores, salary estimates, AI interview debriefs, ideal-answer frameworks, career-coach chat responses, and similar outputs (together, "AI Content"). AI Content is generated automatically and may be incomplete, inaccurate, outdated, or wrong. It is provided for general informational and preparation purposes only and does not constitute professional career, legal, financial, immigration, or HR advice.

You are solely responsible for independently verifying any AI Content before relying on it for any decision including whether to apply to, interview for, or accept a role. We disclaim all liability for actions taken or not taken in reliance on AI Content.

You retain ownership of the notes, interview debrief text, profile narrative, and other content you submit ("User Content"). By submitting it, you grant Jobspiq a worldwide, royalty-free licence to store, process, and display it back to you to operate the Service, and where content is anonymised (e.g. the community interview-question bank described in our Privacy Policy) to make de-identified portions available to other users.

You are solely responsible for your User Content, including any third-party personal data you choose to include in it for example a recruiter's or interviewer's name, phone number, or LinkedIn URL logged in your application tracker or interview notes. By submitting such data you represent that you have a lawful basis to record and share it with us, and you agree that Jobspiq bears no responsibility for your decision to do so. Do not submit content that is unlawful, defamatory, or that you do not have the right to share.

The Jobspiq platform, matching algorithms, brand, and design are owned by Jobspiq Intelligence Systems and protected by applicable intellectual-property law. Job descriptions remain the property of their respective employers. Your profile data remains yours we licence it to run the Service per our Privacy Policy. Nothing in these Terms transfers any Jobspiq intellectual property to you, and you may not copy, modify, or create derivative works of the platform except as the Service itself intends (e.g. downloading your own data).

If you believe content displayed on Jobspiq a job listing, description, or other material infringes your copyright or other rights, email [email protected] with a description of the content and your rights, and we will review and remove it promptly at our discretion.

THE SERVICE, INCLUDING ALL AI CONTENT AND THIRD-PARTY JOB LISTINGS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT: (a) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (b) MATCH SCORES, EXTRACTED SKILLS, OR ANY OTHER AI CONTENT WILL BE ACCURATE OR RELIABLE; (c) ANY JOB LISTING IS GENUINE, CURRENT, OR STILL OPEN; OR (d) USING THE SERVICE WILL RESULT IN AN INTERVIEW, OFFER, OR EMPLOYMENT OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) JOBSPIQ, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY (INCLUDING A MISSED JOB OPPORTUNITY, INCORRECT MATCH SCORE, OR RELIANCE ON AI CONTENT), ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (i) THE TOTAL FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (ii) ₹1,000 (ONE THOUSAND INDIAN RUPEES).

You agree to defend, indemnify, and hold harmless Jobspiq Intelligence Systems, its officers, employees, and affiliates from and against any claim, liability, damage, loss, and expense (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content, including any third-party personal data you submit; (c) your violation of these Terms; (d) your violation of any law or the rights of a third party; or (e) your dealings, interviews, negotiations, or disputes with any employer, recruiter, or candidate encountered through the Service including, for recruiters, any claim arising from a job posting you published or your hiring conduct.

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disaster, war, terrorism, civil unrest, labour disputes, internet or telecommunications failures, government action, or failures of third-party infrastructure, hosting, or AI providers we depend on to operate the Service.

We may suspend or terminate your account, without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or for any other reason at our discretion, including discontinuing the Service entirely. You may delete your account at any time from Profile settings or by emailing [email protected]. Sections that by their nature should survive termination including Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution remain in effect after your account is closed.

Jobspiq provides both Free and Paid Subscription tiers for job seekers and candidates. Paid features are offered under Jobspiq Pro, including:

• Jobspiq Pro 3-Month Switch Sprint: Single upfront payment of ₹699 (effective ₹233/month, Save 22% compared to monthly), providing 90 days of uninterrupted access.
• Jobspiq Pro 1-Month Plan: Billed at ₹299/month on a flexible month-to-month basis.
• Free Tier: Basic job discovery, 90-minute crawling delay, standard search filters, and daily email digests with zero payment required.

Currency & Taxes: All fees are stated in Indian Rupees (INR) and are inclusive of all applicable statutory taxes (including Goods and Services Tax, where applicable) unless explicitly indicated otherwise.

Payment Processing & Security: Subscription payments are securely processed through our authorized payment gateway partner, Razorpay. Supported payment methods include UPI (Google Pay, PhonePe, Paytm, CRED), Credit/Debit Cards (Visa, Mastercard, RuPay, Amex), Net Banking, and authorized digital wallets. Jobspiq does not directly collect, store, or process your sensitive card PINs or full CVVs.

Promotional Codes & Coupons: Any promotional discount codes or referral vouchers are applied at checkout before payment confirmation. Discounts are validated server-side, are non-transferable, and cannot be exchanged for cash.

Self-Service Cancellation: You may cancel your subscription renewal at any time directly through your account Billing Settings or by sending an email to [email protected] from your registered email address.

No Cancellation Fees or Lock-in: There are zero penalty fees for cancelling your subscription.

Access Until Period End: Upon cancellation, you will retain full access to all active Jobspiq Pro features (including real-time 0-minute feeds, instant Telegram Bot alerts, AI resume tailoring, and interview coaching) until the conclusion of your current paid billing period. After the billing period expires, your account will automatically transition to the Free tier without deleting your account history, saved jobs, or application tracker entries.

Digital Services Consumption: Because Jobspiq Pro delivers immediate digital access, real-time autonomous job crawling, AI compute generation (resume tailoring, interview debriefs, and cover letters), and live match notifications upon activation, paid fees are generally non-refundable once the service has been provisioned and utilized.

Eligible Refund Scenarios (7-Day Request Window): You may request a full or partial refund within 7 calendar days of the transaction date under the following verified circumstances:

• Duplicate / Erroneous Billing: You were charged multiple times for the same subscription period due to a payment gateway duplicate transaction or technical timeout.
• Prolonged Service Outage: A verified platform outage or server failure prevented you from accessing core paid Pro features for more than 72 consecutive hours during your billing period.
• Unauthorized Charge: A verified fraudulent transaction made on your payment method without your consent, reported within 7 days of occurrence.

How to Request a Refund: To initiate a refund request, submit an email to [email protected] with the subject line "Refund Request - [Your Registered Email]" along with your transaction ID or Razorpay payment reference.

Review & Settlement Turnaround: Our billing team will review and respond to your request within 2 business days. Once approved, the refund will be credited back to your original source payment method (bank account, card, or UPI VPA) via Razorpay within 5 to 7 business days, subject to your bank's processing cycles.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Before initiating any formal proceeding, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least 30 days.

If a dispute is not resolved informally, it shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by mutual agreement, seated in Bangalore, Karnataka, and conduct in English. Subject to the arbitration clause, the courts at Bangalore, Karnataka shall have exclusive jurisdiction over any disputes arising under these Terms.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jobspiq regarding the Service and supersede any prior agreements.

No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

We may modify these Terms at any time. Where changes are material, we will make reasonable efforts to notify registered users (for example, by email or in-app notice) before they take effect. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms.
